Hotels Using Loyalty Programs To Get You To Book Directly

If you’ve noticed more solicitations from hotel loyalty programs lately, there’s a good reason for that. Hotels would rather give you free rooms now and then than keep losing the commissions that they pay when you book through aggregators like Expedia or Trivago.

Hotels earn more profit when you book directly on their sites, but enticing customers to do so means being more generous with rewards programs. In an interview with Reuters, one industry expert called this endeavor “costly, but necessary.”

Rate parity is a thing

Why can’t hotels just charge less when customers book on their sites? Signing up with online travel agencies means making rate parity agreements that they’ll charge the same price everywhere. Yep, that includes the hotel’s own site.

Loyalty programs give hotel chains one way to give a discount. Instead of giving a discount for booking on the chain’s site, customers get a discount for being loyalty program members, and it happens that they can only sign in to that program on the site.

Wyndham, the owner of brands like Ramada, Days Inn, and Travelodge, only got 9.6% of its reservations directly on its own site, according to third-party audience data company Hitwise. If that seems tiny, it is: Ramada, for comparison’s sake, got over a quarter of its bookings directly on its site in 2017. However, Wyndham tripled its direct bookings in just a year.

Wyndham’s chief marketing officer told Reuters that changes to its loyalty program were really helpful in convincing more customers to book directly. It also helped that the chain made its brands’ websites more friendly to travelers using mobile devices while they’re, you know, traveling.

Whistleblowers Will Receive $3.6M For Reporting Healthcare Company’s False Medicare Claims

Less than a week after federal authorities conducted a massive crackdown on medical fraud, arresting more than 400 individuals, the Department of Justice announced that three Ohio-based healthcare companies and their executives would pay $19.5 million to resolve allegations they falsified Medicare claims for unnecessary services that allegedly harmed patients. 

The DOJ announced Monday the settlement with Foundations Health Solutions (FHS), Olympia Therapy Inc. (Olympia), and Tridia Hospice Care Inc., along with their executives, putting an end to two whistleblower lawsuits filed against the companies.

The inter-related companies composed one of the largest nursing home operations in Ohio.

FHS was created following the merger of Provider Services Inc., which provided management services to skilled nursing facilities, and BCFL Holdings Inc. Olympia provided rehabilitation therapy services to patients at facilities managed by FHS, while Tridia Hospice Care provided hospice care services to the facilities.

Each of the companies were partially controlled or owned by Brian Colleran and Daniel Parker from 2008 to 2013.

Whistleblower Lawsuits

Each of the companies were sued in 2011 and 2012 by former employees under the federal False Claims Act, which allows individuals to sue on behalf of the government and to share in any recovery.

The first lawsuit [PDF], filed by Vladimir Trakhter, a former Olympia employee, accused Olympia and Provider Service Inc. — which is now FHS — of submitting false claims to Medicare from Jan. 2008 to Dec. 2012.

According to the suit, Olympia and FHS’s claims were for medically unnecessary rehabilitation therapy services at 18 skilled nursing facilities.

The suit claims that the companies routinely assigned residents to more costly therapy services, regardless of care and resources, solely to obtain higher levels of Medicare reimbursements.

In cases where the facilities did perform the unneeded or more stringent therapy, the suit alleges that patients were harmed when they were unable to tolerate the therapy.

For instance, one patient with a weak heart, mood disorder, and a temper was overworked and attempted to refuse treatment from two therapists. After arguing with the therapists about his inability to engage in the therapy, the man suffered cardiac arrest and could not be resuscitated, the suit claims.

The second lawsuit [PDF], filed by former Tridia employees Paula Bourne and La’Tasha Goodwin in Dec. 2012, accused the hospice care provider of submitting false claims to Medicare from April 2011 to Dec. 2013.

According to the lawsuit, Tridia submitted false claims to Medicare for hospice services provided to patients who were ineligible for the Medicare hospice benefit because Tridia failed to conduct proper certifications or medical examinations.

Settling Up

Under the terms of the settlement, the companies will reimburse Medicare, and pay $2.9 million to Trakhter, the former Olympia employee, and $740,000 to Paula Bourne and La’Tasha Goodwin, the former Tridia employees.

Finally, FHS and Colleran must enter into a five-year Corporate Integrity Agreement, designed to increase the accountability and transparency so that they will avoid or promptly detect future fraud and abuse.

Family Says Fidget Spinner Caught Fire While Charging

Fidget spinners and hoverboards don’t have much in common on the surface, but they might be more alike than you think: Both are (or were) uber-popular toys for kids, appeared on the streets almost overnight, and can explode… if the toy contains a battery.

Sacramento CBS reports (warning: link contains video that autoplays) that the latest case of an overheated fidget spinner occurred over the weekend as the toy was charging.

As we’ve previously reported, fidget spinners have evolved from their modest designs with mechanical parts to include internal batteries that power bluetooth speakers, lights, and other features.

These batteries, like those used in hoverboards, can be charged — although it’s unclear if the batteries are lithium-ion. And that poses a problem, because if there’s a battery inside a thing, that thing can catch fire when you least expect it.

This was apparently the case in California, where a 12-year-old girl’s toy — equipped with a bluetooth speaker — began to smoke while charging.

The girl, who had picked up the toy, dropped it when she saw sparks. When the girl’s mother entered the room she tells Sacramento CBS that it was filled with smoke.

The spinner, she recalls, was so hot it burnt her hand when she tried to pick it up. The toy, which didn’t have any manufacturer information on it, was left with bubbled plastic.

“If I wasn’t home, that’s scary. That really scares me a lot,” the mother says, noting she was relieved no one was hurt.

Not The First Time

The incident is at least the third in recent months related to the popular fidget spinners. Last month, parents in Alabama and another in Michigan reported that fighter spinners caught fire while charging.

Consumerist has reached out to the Consumer Product Safety Commission about the latest incident, and whether the agency would open an investigation. We’ll update this post when we hear back.

In the meantime, the CPSC has previously advised fidget spinner owners to never leave a product unattended while charging.

The CPSC also urged anyone who has had a safety issue with a fidget spinner — or frankly, any other device, really — to report the problem at SaferProducts.gov.

Now Amazon Wants To Sell You Meal Kits

It’s not enough that meal kit services are advertising on every screen you see and every podcast you hear: Now even the Everything Store wants to sell them to you, too, through its Amazon Fresh grocery service.

The kits, called just Amazon Meal Kits, aren’t yet available nationwide. Geekwire reports that AmazonFresh customers in Seattle can buy them as part of an AmazonFresh membership.

“9 out of 10”

One of the site’s readers is a fan of other meal kit services, and he gave the box a great review, noting that the steak was a nice cut, the peas were very fresh, and that the recipe included fresh peppercorns, something that he had never seen in a meal kit before. The onion was pre-diced, which could be good or bad depending on your onion preferences and your knife skills.

“Overall the finished meal was a 9 out of 10 for any meal I’ve made at home even with my own ingredients,” he wrote.

Amazon’s own kits are slightly cheaper than the competition, costing $18.99 for a box that makes two servings. The normal price point for meal kits is around $10 per serving.

Shaking in their Aprons

Blue Apron, the category leader, recently had its initial public stock offering, and the share price fell (warning: auto-play video at that link) when the news broke that Amazon had merely trademarked the name Amazon Meal Kits.

Other meal kit makers have also teamed up with Amazon to sell individual meals, hoping to hook customers on subscriptions. They either shipp directly or selling through Amazon Fresh. Chef’d will ship kits for two or four people directly, and you can buy Tyson Tastemakers kits or Marley Spoon’s Martha Stewart recipes through AmazonFresh.

Lawsuit Claims Uber Is “99.9% Inaccessible” To People With Mobility Disabilities

How hard is it for someone to get a wheelchair-accessible Uber in New York City? According to a new lawsuit, it’s pretty much impossible.

Nonprofit legal center Disability Rights Advocates filed a class action lawsuit [PDF] on behalf of a coalition of disability groups and disabled individuals in New York City, claiming that the ride-hailing service is 99.9% inaccessible to people with mobility disabilities in all five boroughs, in violation of the city’s anti-discrimination laws.

Not Enough Cars

Despite the fact that Uber offers wheelchair-accessible rides through its UberWAV service, the complaint alleges that of the company’s fleet of about 58,000 cars, there are fewer than 100 vehicles available that have lifts or ramps necessary to transport people using wheelchairs or other mobility-assistive devices.

Citing data from the United States Census American Community Survey conducted in 2014, the lawsuit claims that more than 500,000 non-institutionalized NYC residents have a mobility-related disability — and that’s not including the “hundreds of thousands of people with disabilities” that visit the city each year, the complaint claims.

In addition, it’s not like people with wheelchairs are the only ones using these vehicles; they aren’t reserved “for or used exclusively by mobility disabled passengers; they are available to and used by non-disabled passengers through UberX and other vehicle classes,” the complaint claims, a problem that is exacerbated during peak demand hours.

What this all boils down to is a lack of availability, the lawsuit says.

“Passengers attempting to use Uber’s accessible service face extended wait times, or are still denied access to the service altogether, demonstrating that the new service is nothing more than window-dressing, designed to avoid government regulation and legal requirements,” the complaint alleges.

Plaintiffs include the Brooklyn Center for Independence of the Disabled, the Taxis For All Campaign, Disabled In Action of Metropolitan New York, and individuals who use wheelchairs.

Transportation Challenges Aplenty

This lack of cars is especially tough on people with disabilities, as Uber “could be an especially crucial transportation option” for them, because other options in the city present barriers to access, the complaint claims.

“For example, the subway system, the city’s quickest, most important travel option, is largely unusable by people with disabilities as almost 80% of its stations are inaccessible for anyone who cannot use stairs,” reads the lawsuit.

In addition, the subway system doesn’t extend to all NYC neighborhood, unlike Uber. And although the city has agreed to ensure that 50% of all yellow cabs are accessible by the end of 2020, “Many drivers have abandoned medallion taxi cab jobs, turning to Uber” instead, the suit notes.

On-demand transportation services can fill these gaps for riders with disabilities, the lawsuits claims — “if they are operated in a non-discriminatory way.”

Because transportation is crucial for freedom and independence Uber is harming riders who need wheelchair-accessible vehicles by denying them equal service, the complaint alleges, by “interfering with the ability to work, attend school, shop for groceries, receive medical care, enjoy entertainment and cultural events, maintain family and social ties, and otherwise participate fully in the life of the city.”

Instead, riders who use wheelchairs have to arrange other transportation that could be more costly, less convenient, and less comfortable, the lawsuit claims. Or they could forgo activities that require travel altogether “which can lead to isolation and seclusion.”

“Uber provides a valuable transportation alternative to millions of New Yorkers, allowing people to more easily travel to work, social events, community engagements, appointments, and other destinations, yet Uber excludes people with mobility disabilities from these same benefits of its convenient transportation,” the lawsuit claims.

It’s seeking class-action status, and wants Uber to implement a plan “to ensure full and equal access to its services for riders who require accessible transportation.”

A rep for Uber maintained to Consumerist that the company has expanded access to reliable transportation for all riders, including those with disabilities. .

“While there is certainly more work to be done, we will continue advocating for a solution that offers affordable, reliable transportation to those who need a wheelchair accessible vehicle,” the rep told Consumerist.

No Stranger To Mobility Complaints

This isn’t the first time Uber has faced this kind of lawsuit: Last fall, a Chicago disability rights group sued the company claiming that it doesn’t provide reliable access to vehicles equipped to handle wheelchairs.

Riders in Washington, D.C., also sued Uber recently, accusing it of denying equal access to people who use wheelchairs.

While many banks have modified their policies regarding the costly fees, recent reports found those changes aren’t enough to protect most consumers. Now, in an effort to add to those protections, one lawmaker is pressing banks for more information on their policies.

New Jersey Senator Cory Booker sent letters [PDF] to 13 major U.S. banks Monday asking for information about their current overdraft-fee programs and the institutions’ push to have customers enroll in so-called “overdraft protection” programs.

“I’m concerned that too many of our nation’s banks are increasingly driven to accumulate these fees, rather than pursue a business model that serves their communities,” Booker wrote in the letter.

Looking For Answers

Booker said Monday that his letter seeks to uncover additional information about overdraft practices from 13 banks, including Chase Bank, Wells Fargo, Bank of America, TD Bank, PNC Bank, SunTrust Bank, Regions Bank, Branch Banking and Trust (BB&T), Woodforest Bank, Ameris Bank, Bank Plus, U.S. Bank, and Ocean Bank.

These banks, Booker says, represent the top 10 U.S. banks in overdraft and non-sufficient-funds revenue, as well as the U.S. banks with over $2 billion in assets that take in the most overdraft and non-sufficient-funds revenue per account.

The letters ask the banks to provide information on how much the bank depends on overdraft fees for revenue, how many new customers opt-in to overdraft protection, what type of incentives employees are given to boost enrollment in overdraft programs, and the process by which consumers opt-in to such programs.

Booker gave the banks until Aug. 11 to respond to the letters.

Overdraft Issues

Booker cites a 2014 Pew study that found more than half of the customers who overdrew their checking accounts, incurring a fee, did not remember consenting to overdraft service.

Under federal law, depository institutions are prohibited from charging overdraft fees on ATM and one-time debit card transactions unless consumers affirmatively opted in. If customers don’t opt in, banks may decline the transaction because of insufficient or unavailable funds, and can’t charge an overdraft fee.

However, recent enforcement action from federal regulators shows that not all banks have followed these rules.

Back in January, the Consumer Financial Protection Bureau accused TCF Bank of tricking customers into its costly overdraft program by obscuring fees and creating loose definitions of consent.

TCF Financial, which operates 376 branches in Illinois, Minnesota, Michigan, Colorado, Wisconsin, Arizona, South Dakota, and Indiana, operates an overdraft program much like those at other financial institutions, charging on average $35 every time a customer overdrafts by spending or withdrawing more money than is available in their account.

Prior to that action, the CFPB in July 2016 fined Santander Bank $10 million for alleged illegal overdraft practices. The fine came after the CFPB accused the company’s telemarketing vendor of deceptively marketing an overdraft service and signing certain bank customers up for the service without their consent.

Booker notes in the letter that he’s worried that such deceptive overdraft practices are “undermining trust in our nation’s bank, leading many consumers to abandon banks altogether after seeing their saving drained by fees.”

Sears Holdings CEO Lends Company Another $200M To Stay Afloat

As other retailers around it go out of business or reorganize, Sears Holdings, parent company of Kmart and Sears, is still in business somehow. Why? Those other chains don’t have what SHC does: A massive base of stores that it owns and can sell, and a CEO able to lend the company a few hundred million here and there.

The manifesto-writing chairman and CEO of Sears Holdings, Eddie Lampert, is also the company’s biggest investor. He rarely visits the company’s headquarters in the Chicago suburbs, and doesn’t seek out publicity, with the exception of a recent interview with the Chicago Tribune where he discussed the current state of the company, and how he wishes that the media would stop speculating that the company is about to file for bankruptcy.

The $200 million from Lampert’s hedge fund, ESL Investments, is meant to give the company some financial breathing room. Loans from the $200 million line of credit last for 151 days. This will probably not ease suppliers’ fears that the company will default on its debts and fail to pay them for merchandise.

“This facility is intended to provide the Company with the flexibility to generate additional liquidity on an as-needed basis,” the company said in a statement about the new line of credit to CNBC.

That gives the company more financial room and more time to sell more of its property to a retail real estate investment trust largely owned by Lampert. The company has continued to close stores across the country, shuttering mostly its Kmart discount stores.

ESL Investment is also in talks for some kind of deal with Sears Canada, which filed for the Canadian equivalent of Chapter 11 bankruptcy last month and is seeking refinancing of its debt or a sale. The fund is already a major investor in Sears Canada.

Chipotle Temporarily Closes Location After Customers Report Becoming Violently Ill

If you live in Virginia and were planning to grab Chipotle for lunch, you might want to make sure your local restaurant isn’t closed: The fast casual chain temporarily shut down a location in the state after more than a dozen customers became ill.

Business Insider reports that Chipotle temporality closed its Sterling, VA location Monday in order to sanitize the restaurant following reports that customers became ill after eating there.

“We are working with health authorities to understand what the cause may be and to resolve the situation as quickly as possible,” Jim Marsden, Chipotle’s executive director of food safety, told Business Insider.

The company says it plan to reopen the restaurant today.

Vomiting, Fever, Diarrhea

Issues at the location came to light Monday after the website iwaspoisioned.com revealed it had received eight reports indicating 13 customers fell sick after eating at the restaurant between July 14 and July 15.

In all, customers reported “vomiting violently” and “violent stomach cramps” for several days after eating at the restaurant. At least one person made two trips to the hospital.

A rep for Chipotle tells Business Insider that the company is aware of the reports and believes the symptoms are consistent with norovirus.

Another Contamination?

Norovirus differs from contaminations like E.coli and salmonella, as it doesn’t originate in food.

According to Centers for Disease Control and Prevention statistics, 70% of outbreaks originate when a sick person serves food. The virus can also spread to people who happen to be in a room where someone with the virus vomits.

If the Sterling health issues turn out to be norovirus, it wouldn’t be Chipotle’s first run-in with the illness.

In Dec. 2015, Chipotle closed a Boston College location after more than 100 students became ill.

Then in March 2016, the company temporarily closed another Massachusetts restaurant after a worker was diagnosed with the virus. However, no customers reported becoming ill. The following month, Chipotle temporarily closed a Chesterfield, VA restaurant after someone became sick inside.

Taking Precautions

The temporary closures of the Virginia and Massachusetts location came as part of Chipotle’s new safety protocols. Following Chipotle’s highly public battle with food-borne contaminations and other illnesses in late 2015, the company made policy changes intended to reduce the odds of future problems.

In addition to new food safety protocols — like having raw veggies chopped at a central kitchen, dipping onions in boiling water, and marinating raw chicken in sealed bags — the burrito chain decided to give employees sick leave, and said that restaurants will be temporarily shut down for cleaning after anyone vomits inside the building.

Someone Sued Because ‘Natural’ Nature Valley Granola Bars Contain Common Pesticide

Although the term “natural” is not defined by the federal government — allowing basically any food company to slap it on a product’s label — a judge has decided that General Mills’ use of the term to describe granola bars that contain herbicide is not deceptive.

A Quartet Of Claims

First, some background: A quartet of lawsuits claimed last summer that General Mills is deceiving customers with a label on Nature Valley granola bars that says the snacks are “made with 100% natural grain oats,” because the products contain small amounts of a widely used pesticide called glyphosate.

Although the level of pesticide in the bars is well below the Environmental Protection Agency’s limits, the suit says it’s still too much for the product to merit a “100% natural” label.

Those lawsuits were consolidated into a single class-action, which was brought before Judge Michael J. Davis in a Minnesota district court.

A Lack Of Allegations Against Oats

In granting General Mills’ motion to dismiss the suit [PDF], Davis said that “regardless of whether and how the FDA does decide to take up the definition of the term ‘natural,’ which it has so far declined to do, the plaintiff’s claims in this case are simply not plausible.”

Davis doesn’t have an issue with the plaintiffs’ allegation that the granola bars contain trace glyphosate, but points out that consumers shouldn’t hold the products to a stricter standard when it comes to herbicide residue than the federal government does for anything labeled “organic.”

Under those regulations, foods bearing the “organic” label are allowed to contain chemical pesticide residue, so long as it is less than 5 percent of EPA tolerance for the detected residue.

Noting that consumers generally conflate the ideas of “natural” and “organic” — or hold products labeled “organic” to a higher standard than those labeled “natural” — Davis says it is”implausible that a reasonable consumer would believe ingredients allowed in a product labeled ‘organic,’ such as the Challenged Ingredients, would not be allowed in a product labeled ‘all natural.’”

He further notes that plaintiff’s failed to plausibly allege a breach of warranty because General Mills didn’t “warrant that Nature Valley Products would be free from trace glyphosate.” Rather, the product’s packaging said they were “Made with 100% Natural Whole Grain Oats.”

“And there is no dispute that the products were made with whole grain oats that, themselves, are ‘100% Natural,’ Davis notes. “Even if the glyphosate traces are present on the oats, there is no allegation that the oats, themselves, are not natural. The packaging does not state that the product, as a whole, is ‘100% Natural.’ ”
