Appeals Court Deals Blow To Streaming Service That Lets You Filter Out Nudity & Swearing

VidAngel is a streaming service that allows subscribers to filter out nudity, violence, swearing, or anything else they might find offensive in a movie or TV show. Today, a federal appeals court dealt the latest blow to VidAngel, saying that the service likely violates federal copyright law, and keeping in place an injunction that prevents the service from reproducing and streaming videos without permission.

In addition to its library of content that doesn’t require any filtering, VidAngel has a way for subscribers to view custom, cleaned-up versions of other titles.

But because merely editing down and rebroadcasting a movie to all your customers without the studio’s permission would be a clear violation of copyright, VidAngel attempted to take a novel approach to making an end-run around this concern.

The company has a vault full of DVD and Blu-ray discs for a variety of titles. It also uses software to decrypt and create a digital master file that is then stored on the cloud along with digital markers that would allow users to filter out up to 80 different types of offensive or sensitive content.

When a subscriber wants one of these movies, they “purchase” one of the physical discs from VidAngel’s vault but they don’t actually receive it. Instead, they are given access to the streaming video that they can then filter per their own desires. What’s more, the subscriber can then “sell” the disc back to VidAngel for $18 or $19, effectively meaning they paid $1 or $2 for streaming that title. After selling the title back, the customer no longer has access to the streaming file.

The notion is that — at least for the time during which the customer “owns” the disc — they should be able to watch the movie in any form they wish.

But there are multiple legal hiccups with VidAngel’s process. Federal copyright law states that copyright holders have the exclusive rights to reproduce or broadcast their content. Additionally, the Digital Millennium Copyright Act (DMCA) puts heavy restrictions on decrypting copyrighted digital content, which VidAngel must do in order to make its file for streaming from the cloud.

VidAngel also kicked up a hornet’s nest when it decided to make high-profile titles, like Star Wars: The Force Awakens, available for streaming before they could be found on Netflix or other platforms that had reached licensing deals with the studios to show their movies and shows.

In 2016, Disney, Lucasfilm, Twentieth Century Fox, and Warner Bros. jointly sued VidAngel, and in Dec. 2016 a District Court judge granted a preliminary injunction [PDF] against the streaming startup, finding that the studios were likely to succeed on their DMCA and copyright allegations. The judge said that purchasing a DVD does not automatically give the purchaser any right to circumvent the encryption on the disc. Nor does the Family Movie Act of 2005 (FMA) — which added some new protections for people hoping to create clean versions of movies they own — allow for DVD owners to bypass copyright protection tech.

The District Court judge also said that VidAngel was violating the studios’ copyrights by reproducing and broadcasting content without permission.

VidAngel had tried to argue that its reproduction and streaming constitutes a protected fair use of the copyrighted materials, but the court found that this argument appeared to fail every one of the four factors that go into determining whether something is considered fair use: It’s commercial and non-transformative; the materials being reproduced and streamed are worthy of copyright protection; the VidAngel versions of the videos are ultimately too similar to the original works; and the existence of these new versions has an effect on the potential market for the original content.

Today, the a three-judge panel for the Ninth Circuit Court of Appeals upheld the District Court’s injunction [PDF], finding that VidAngel’s interpretation of the FMA would create a “giant loophole in copyright law, sanctioning infringement so long as it filters some content and a copy of the work was lawfully purchased at some point.”

The panel points out that “virtually all piracy of movies originates in some way from a legitimate copy,” so if that one authorized original copy was enough to justify all subsequent copies, “the statute would severely erode the commercial value of the public performance right in the digital context, permitting, for example, unlicensed streams which filter out only a movie’s credits.”

The best line of the Ninth Circuit’s ruling comes from its analysis of the fair use argument, where the panel shoots down VidAngel’s argument that its filtering is substantially transformative.

Star Wars is still Star Wars, even without Princess Leia’s bikini scene,” explains the appeals panel.

And so the preliminary injunction remains in place.

In a statement posted on the VidAngel site, CEO Neal Harmon says the Ninth Circuit decision has “absolutely no impact on VidAngel’s current service, we remain open for business. While all of the legal back-and-forth plays out, we know our customers are grateful to still have a way to protect their kids and filter harmful content. On the legal front, we are just getting started. We will fight for a family’s right to filter on modern technology all the way.”

Aetna Letters Publicly Revealed Patients’ HIV Status

Health insurance giant Aetna recently alerted thousands of policyholders of a change to their pharmacy benefits. Problem is, Aetna sent those letters out in envelopes that revealed that the recipients is HIV positive.

The Legal Action Center and the AIDS Law Project of Pennsylvania today called on Aetna to correct the issue, apologize, and stop the mailings after customers in several states say their privacy was violated by the insurance company.

According to the consumer organizations, on July 28 Aetna sent mailings to about 12,000 customers informing them of changes on how to fill the prescription for their treatment of the HIV virus. However, customers say that when they received the letters, their names and medical information — including that they were receiving treatment for HIV — were visible through a large window on the front of the envelope.

“Aetna’s privacy violation devastated people whose neighbors and family learned their intimate health information,” Sally Friedman, legal director for Legal Action Network, said in a statement. “They also were shocked that their health insurer would utterly disregard their privacy rights.”

The groups say they have heard from consumers in Arizona, California, Georgia, Illinois, New Jersey, New York, Ohio, Pennsylvania, and Washington, D.C, who have been affected by the mailings.

The revealing envelopes have caused “incalculable harm” to Aetna beneficiaries, the group said in a letter [PDF] to the insurer.

“We demand that Aetna immediately cease and desist from sending any mail that reveals beneficiaries’ medications or other protected health information to anyone other than the individual who opens the envelope,” the organizations wrote.

For its part, Aetna tells STAT News that it is in the process of notifying both state and federal authorities about the issue.

“We sincerely apologize to those affected by a mailing issue that inadvertently exposed the personal health information of some Aetna members,” the spokesman said. “This type of mistake is unacceptable, and we are undertaking a full review of our processes to ensure something like this never happens again.”

Aetna notes in a letter sent to customers, and viewed by STAT News, that the issue could have been caused by the paper shifting in the envelope. The company suggested that the personal information visible through the window did not name a particular medication or that customers had been diagnosed with a specific condition.

However, a photo (above) of the mailing provided by Legal Action Center and the AIDS Law Project of Pennsylvania shows more information was visible.

Amazon Prime Members Will Get Special Discounts At Whole Foods Stores

If you’ve been wondering what the marriage of Whole Foods and Amazon will look like, we now have one clue that’s more tantalizing than a bundle of young asparagus. In the companies’ official wedding announcement today, their leaders announced how they plan to open up special deals at physical Whole Foods stores to subscribers to Amazon’s Prime service, and place Amazon Lockers in Whole Foods stores.

The Federal Trade Commission announced yesterday that it would not pursue an investigation of Amazon’s acquisition of Whole Foods. The upscale grocer’s shareholders approved the acquisition earlier this week, which means that there’s nothing standing in the companies’ way, and the deal will close on Monday, Aug. 28. Starting that day, there will be a few changes introduced at Whole Foods stores, the companies said.

Tilapia and baby kale for everyone!

Instead of implementing its own rewards program and discount card, Amazon Prime will become the discount and loyalty program for Whole Foods stores. Prime costs $99 per year, $10.99 paid monthly, and $5.99 paid monthly for members who receive certain government benefits for people living in poverty..

Whole Foods stores will discount a variety of basic healthy foods. A partial list of items that they provided in the announcement is Whole Trade bananas, organic avocados, organic large brown eggs, organic responsibly-farmed salmon and tilapia, organic baby kale and baby lettuce, animal-welfare-rated 85% lean ground beef, almond butter, organic Gala and Fuji apples, organic rotisserie chicken, and the store’s own brand of organic butter.

What Amazon hasn’t announced yet is how this will work. Will Prime members be issued cards, will they have virtual cards that live as a smartphone barcode on the Amazon app, or will they log in to their accounts on checkout terminals? Will they spell out their email addresses for cashiers?

The Vision

After the deal officially closes on Monday, the two corporations will skip joyfully hand-in-hand through fields of kale and fulfill their joint vision. That vision, they explain in the announcement, is “making Whole Foods Market’s high-quality, natural and organic food affordable for everyone.”

Amazon will also eventually begin to sell Whole Foods’ house brands on the main Amazon site and through Prime Fresh and Prime Pantry. Those brands include 365 Everyday Value, Whole Paws, and Whole Catch.

This isn’t the first time that Amazon has brought Prime pricing out into the real world. Amazon also does this in its small physical bookstores, where Prime members pay a mysterious price that they must look up with a smartphone, while everyone else has to pay the publisher’s suggested price.

Judge Throws Out Dozens Of Lawsuits Over Cellulose In ‘100% Grated Parmesan Cheese’

The recent revelation that your grated parmesan cheese might contain some cellulose powder led to dozens of lawsuits against Kraft Heinz, Walmart, Target, Albertsons, Publix, and others, alleging that these companies misled shoppers with labels that declared “100% grated parmesan” or something similar. But today the federal judge overseeing all these disputes dismissed the lawsuits, saying that people should read the labels on the food they buy.

Plaintiffs in these lawsuits, filed in courts all over the country, argued that they believed they were buying containers that contained only grated cheese, and did not know that the stuff they sprinkled on their spaghetti allegedly contained as much as 8.8% cellulose powder, or other ingredients like potassium sorbate, or corn starch.

Since the dozens of lawsuits are all effectively making the same claims, they have all been consolidated into one multi-district litigation overseen by a federal judge Gary Feinerman in Illinois, who today simultaneously dismissed all cases.

Ultimately, Feinerman found that “100% grated parmesan cheese” is an ambiguous statement that is open to multiple interpretations.

“Although “100% Grated Parmesan Cheese” might be interpreted as saying that the product is 100% cheese and nothing else, it also might be an assertion that 100% of the cheese is parmesan cheese, or that the parmesan cheese is 100% grated,” explains the judge [PDF]. “Reasonable consumers would thus need more information before concluding that the labels promised only cheese and nothing more, and they would know exactly where to look to investigate — the ingredient list. Doing so would inform them that the product contained non-cheese ingredients.”

Feinerman points out that each of the products involved in the lawsuit clearly lists cellulose and the other ingredients on the label, and that “Each ingredient list states that the cellulose is added ‘to prevent caking.'”

In his opinion, a reasonable consumer would know that pure cheese is not shelf-stable at room temperature and couldn’t sit in sealed packaging in a grocery store for long periods of time.

“Cheese is a dairy product, after all, and reasonable consumers are well aware that pure dairy products spoil, grow blue, green, or black fuzz, or otherwise become inedible if left unrefrigerated for an extended period of time,” notes the judge.

The plaintiffs’ attorneys disagreed, arguing that reasonable consumers should not be expected to understand “intricacies relating to the shelf life and processing of” grated cheese, but Feinerman says one need not be familiar with the minutiae of the packaged cheese business to know that there must be something preserving the grated cheese products.

A reasonable consumer, concludes Feinerman, “would still suspect that something other than cheese might be in the container, and so would turn it around, enabling them to learn the truth from a quick skim of the ingredient label.”

Feinerman has given plaintiffs’ attorneys until Sept. 14 to amend their complaints.

Alamo replied by thanking the commenter, noting, “We might actually have to steal that clown idea.”

3 Reasons Your Applause Might Not Matter To Pilots

There’s nothing better for a timid flyer than to land safety at their destination after a bumpy, turbulence-filled flight. But before you press those hands together in an exuberant clap, you might want to reconsider. Turns out, some pilots don’t like to receive rousing applause.

That revelation comes after several pilots shared their feelings about post-flight applause on Quora, suggesting that a simple, “nice job” might be preferred to a round of clapping.

There appear to be a few reasons for this, according to the pilots:

1. You Don’t Know What’s Going On

One 20-year-veteran of the airline industry wrote that the applause isn’t needed, as passengers aren’t really in the “know” when it comes to what’s happening with the flight.

“Passengers really have no idea what’s going on up front with the landing, so how do they know what to clap for and what not to clap for?” he asked.

For instance, he suggests that when a flight encounters a rough landing, the pilot may have been working as hard as he could to land the aircraft, but the passengers only feel as if they’re being vibrated around their seats. Instead of a round of applause for landing safely, the passengers might exit remarking that it was the “worse landing I’ve ever had.”

“The point being, we really don’t pay attention to any applause from the back because we grade ourselves based on the situation that day,” the pilot notes. “We’re not really interested in what seat 20B thinks.”

2. Sometimes The Applause Isn’t For Them

Other pilots wrote on the thread that the applause coming from passengers often isn’t for them at all.

“I thought people were just happy to be at their destination,” a retired airline captain wrote.

Another pilot noted echoed the sentiment, noting that, in his view, the applause isn’t necessary because passengers can simply thank the pilot on their way off the plane.

3. Just Another Part Of The Job

Several pilots wrote that while the applause was nice, and they might have enjoyed it, the expression wasn’t really something they thought about.

“As a human being, I appreciate the applause,” another pilot wrote. “It’s always nice when people give wholehearted positive feedback. As a professional pilot, it doesn’t really matter to me.”

Still, in the end, most of the pilots said they’d never turn down applause.

United Airlines Staff Getting Designer Uniforms From Brooks Brothers

Although it’s not that difficult to pull off a more polished look than “elastic-waist pants and a sweatshirt,” United Airlines flight attendants and other employees will probably be dressed better than many travelers with plans for new Brooks Brothers uniforms.

After Delta Air Lines rolled out new designer outfits by Zac Posen for its staff last year, United Airlines will follow its rival down the fashion aisle: The carrier announced on Thursday that it’s working with Brooks Brothers, designer Tracy Reese, and apparel company Carhartt on a new line of uniforms for its more than 70,000 frontline employees, with a planned 2020 rollout.

New duds

All United pilots, male flight attendants, and customer service representatives will have uniforms designed and manufactured by Brooks Brothers; female flight attendants and customer service workers will have outfits designed by Tracy Reese and manufactured by Brooks Brothers; and ramp service, technical operations, and catering operations workers will be wearing duds by Carhartt.

All flight attendants will also be getting a choice of two different Tumi rollaboard bags.

“The partners we’ve selected uniquely match what our employees asked for in a uniforms program – style, comfort, and durability,” said Kate Gebo, senior vice president of global customer service delivery and chief customer officer of United.

Time for testing

The new uniforms are part of a multi-year effort by United “to ensure the proper amount of time for collaboration among employees, labor leadership and the partner brands as well as ample time to test uniforms before finalizing designs and materials.”

There will be multiple “thorough wear tests with employees,” United notes.

Testing can be a very important factor: Amid American Airlines’ recent issues with new uniforms that some employees claim cause rashes and other illnesses, the union that represents flight attendants repeatedly insisted that more testing was needed. The airline and the company that manufactured the uniforms maintained that there had been plenty of tests, and that the clothing is perfectly safe to wear.

American has since offered employees an alternative to the controversial uniforms, and dropped the supplier that makes them.

Taking Out A Reverse Mortgage To Delay Social Security Might Not Be The Best Idea

More than two years after the Consumer Financial Protection Bureau found that reverse mortgage ads create a false impression of the financial product, the agency is once again warning older consumers about the dangers of using reverse mortgages. This time, the CFPB is warning against using reverse mortgages to provide income that would allow the individual to delay Social Security benefits, which can increase their future monthly benefits, but decrease their overall, long-term financial outlook. 

The CFPB today released a report highlighting how the risks of taking out a reverse mortgage exceed the benefits one might expect from delaying their Social Security lifetime benefit claims.

Reverse mortgages allow a borrower, 62 years or older, to convert the equity on their home into either a lump sum or monthly payments. The funds are not required to be paid back until the borrower moves or dies, however, they come with fees and incurred interest.

According to the agency, financial professionals are increasingly promoting the use of a reverse mortgage loan as a way to delay claiming Social Security benefits.

Through this approach, a homeowner uses a reverse mortgage loan to replace the income they would otherwise have received by claiming Social Security benefits at an early age.

Individuals can begin to draw these benefits at the age of 62. However, if they delay taking the benefits until a later age, their monthly Social Security benefit increases, as does their cumulative lifetime benefit. For example, a woman age 62 today who lives to age 85 will receive $29,640 more in cumulative benefits during her lifetime if she claims a monthly benefit of $1,300 at age 67 than if she claims a monthly benefit of $910 at age 62.

Less Of A Benefit

According to the CFPB’s report, while increasing your benefits later in life might seem like a good idea, doing so by taking out a reverse mortgage likely isn’t the best option.

For instance, the agency found that the average reverse mortgage costs can exceed the lifetime benefit of waiting to claim Social Security.

The average length of a reverse mortgage for borrowers at the age of 62 is seven years. By the age of 69, the average borrow will pay approximately 60% in costs, when considering interest, insurance, and fees.

To this end, the CFPB calculates that by age 69, a borrower who takes out a reverse mortgage will pay $2,300 more than the cumulative lifetime amount the typical borrower will expect to gain from delaying their Social Security.

Limiting Future Options

In addition to not actually gaining benefits, a reverse mortgage borrower can expect to see a reduction in home equity.

The CFPB cautions that reverse mortgage borrowers who plan to sell their homes are at risk, as their loan balance is likely to grow faster than their home value will appreciate.

For example, if a 62-year-old homeowner who has a home worth $175,000 with an appreciation value at a rate of 4% takes out a reverse mortgage with a 5.9% interest rate the equity in their home will decrease.

In five years, when the homeowner is 67, the home’s value will be around $212,914, but their equity will only be about 64% of the home’s value, according to the CFPB.

This value decreases even more over time; at the age of 85, the homeowner will only have 46% equity in the home.

Looking For Other Options

The CFPB concludes that there are other options for those looking to delay or build up their Social Security benefits, including working past the age of 62.

The extra years of work often provide people more time to save for retirement and pay off debts, the CFPB notes, adding that it also can result in an increase in Social Security benefits — separate from the increase that arises from deferring the start of benefits — by replacing years with low or no earnings from the person’s earnings record.

Older consumers could also consider coordinating their claiming decision with their spouses to increase their Social Security benefits.

Know Before You Owe

In an effort to better inform homeowners of the potential risks of taking out a reverse mortgage, the CFPB created a handy consumer guide [PDF] and and video.

The guide and video cover issues to consider before applying for a reverse mortgage, such as how much a homeowner can borrow and how the loans work; the possibility of losing the home by failing to meet loan requirements; and what happens to the home after the borrower no longer lives there.

Breaking News: It’s No Longer “Cool” To Eat Brains

Put down that fork! You were probably about to enjoy a delicious plate of steaming hot brains, but we’ve got news: Eating animal organs and entrails has become so normal in restaurants these days, it’s no longer cool to consume brains.

Times used to be, if offal — brains, intestines, kidneys, testicles, headcheese and the like — was on the menu, only the most adventurous eaters out there would be tempted to partake.

But partly due to the influence of celebrity chefs like Mario Batali and culinary travelers like Anthony Bourdain — as well as regular people who like to try new things abroad — Americans are becoming more comfortable with seeing things like brain ravioli and pig’s head on the menu, Bloomberg reports.

Chris Cosentino, author of a new cookbook called Offal Good and chef at Cockscomb in San Francisco, says that the more we travel, the more of influence other cultures have on what we eat.

He tells Bloomberg it’s now normal to eat offal, after years of chefs pushing the public to try to eat something they’re scared of.

“You don’t have to yell at them to eat a carrot. But now, it’s considered a norm,” he says of dining on brains and other innards. “It’s stopped being so cool.”

Another reason you may see offal on a menu near you? Restaurants like saving money, and organ meats are much cheaper than other cuts.

Here Are The 28 Kmart Stores Closing Later This Year

Sears Holdings, the parent company of Kmart and Sears, shared in its most recent quarterly earnings report that it plans to close 28 more Kmart stores. The company saved the closures list for later in the day, and now we have it for you.

California is the hardest hit state, with four locations closing. Illinois is losing three stores, as are New York and Kmart’s original home state of Michigan.

The list includes the North Miami Beach location where the world’s only Kmart Dental clinic operates. The practice predated the store, having been part of a Jefferson Ward store that was in the building before. It’s busy, and can patch in to the store’s public address system, but even that isn’t enough to save a store during a period of relentless cost-cutting.

Caribou Coffee Gets Hungry, Buys Bruegger’s Bagels

When you already own a donut company, a sandwich chain, and a handful of coffee brands, what do you buy next? If you’re JAB Holdings you seek out bagels: The parent company of Krispy Kreme, Panera, Caribou Coffee, Peet’s Coffee & Tea, and Keurig Green Mountain has bought Bruegger’s Bagels. 

Le Duff America announced today that it has entered into an agreement to sell its Bruegger’s Bagel chain to Caribou Coffee for an undisclosed amount.

The Minneapolis Star Tribune reports that the marriage between JAB’s Caribou and Bruegger’s isn’t entirely surprising.

Caribou and Brugger’s experimented with co-branded stores several years ago. However that relationship ended when JAB bought another bagel brand, Einstein Bros, which eventually co-branded with Caribou.

Today’s deal is just the latest for JAB — the investment arm of German conglomerate Joh. A. Benckiser— and its growing portfolio of breakfast and coffee brands.

Back in April, the company announced that it would add Panera to its roster for $7.5 billion. Before that, the company scooped up Stumptown Roasters, then Keurig Green Mountain for $13.9 billion in 2015. In 2012, JAB purchased Peet’s.

Bizarre KFC VR Escape Room/Training Exercise Haunted By Ghost Of Anti-Robot Col. Sanders

What do you get when you combine virtual reality, escape rooms, corporate training videos, and a very cranky fast food mascot? In the case of KFC’s bizarre new VR training video, probably the weirdest eight minutes of your day.

As seen in a demo of a game designed for the Oculus Rift, KFC trainees will find themselves locked in a room that seems to be some sort of shrine to the company filled with chicken decor and inhabited by what I can only guess is the ghost of Colonel Sanders, who does not ever stop talking.

The only way to escape the room and the colonel’s incessant, cranky narration is to correctly fry a batch of chicken, following the ghost’s instructions to inspect, rinse, bread, rack, and fry.

Things take an especially bizarre turn when it comes time to learn how to bread the chicken: Col. Sanders’ ghost begrudgingly accepts the help of a pair of robotic arms to demonstrate the proper technique, while taking a vehemently anti-robot — pronounced “ro-butt” — stance.

“But robots could never make the chicken,” he grumbles. “Robots are just stupid pieces of dumb metal without souls or mouths. I demand a human touch in my kitchen.”

In the end, the only way to escape and “enter the light,” as the colonel so eerily puts it, is to use your disembodied hands to feed a perfectly fried drumstick to the mouth of a Col. Sanders head on the door.

“You are ready to cook my original recipe chicken like a professional, well done,” he says. “Now you may leave this delicious prison and ascend, ASCEND! ASCEND, MY FRIEND! GO NOW! GO!”

It’s probably time you watch for yourself:

Is this real life, or is this just fantasy?

You’re probably wondering if this is a real training program and yes, yes it is. The program hasn’t started yet, but when it does, actual employees will be taken through a 10-minute game, which speeds up the usual 25-minute process of preparing and frying chicken.

“KFC will use the VR simulation to supplement its robust, multi-step employee training program, called Chicken Mastery Certification, which provides detailed eLearning and hands-on training for cooks in each of KFC’s kitchens,” the company says in a press release. “KFC will provide yet another platform for training by bringing the VR simulation technology to its regional general manager training classes, quarterly franchise meetings, and employee onboarding.”

Could wacky VR training videos be the new wacky airline in-flight safety videos? Only time will tell.

Kmart Closing 28 More Stores, Cites Ongoing ‘Transformation’

The news in Sears Holdings’ report to investors isn’t as bad as it could be, but it’s devastating if you’re one of the employees or customers of the 28 Kmart stores that are part of a new round of closures that the company announced today.

The company dropped that news, its first list of store closings in a month and a half, while claiming that more store closures are all part of an ongoing “transformation” into a 21st-century retailer. (The company will announce those closures later today, and we’ll post them when we get them.)

The bad news

In the retailer’s quarterly report, comparable-store sales, the only fair measure of performance when a retailer has been closing as many stores as Sears Holdings, are not good. Kmart stores had a 9.4% decline in comparable-store sales. Even when you account for the pharmacies closing in some Kmart stores and dramatic cutbacks in consumer electronics, sales are down 6.8%.

Sears stores are in a similar leaking boat: Their sales are down 13.2%, and 12.1% when excluding the consumer electronics that the chain has dropped.

“The company’s sales dropped from “softness in store traffic and elevated price competition in the retail industry,” chief financial officer Rob Riecker explained in the retailer’s scripted and pre-recorded quarterly conference call [PDF].

It’s true that retail overall isn’t doing great right now, but the big-box stores and department stores that compete with Sears have mostly stopped the bleeding this quarter. Still, relentless cutting is not necessarily a path to profitability in the retail business. That’s called a death spiral.

The good news

We’ve shared a lot of the good news in the quarterly report here before. The company is working toward its goal of selling $1 billion in real estate to the Seritage Growth Properties real estate investment trust and other interested buyers, and either leasing back or closing affected stores.

It’s experimenting with new formats, which include rebranding Auto Centers as DieHard Auto Centers, which exist independently of Sears stores. The company is also experimenting with a new format, a smaller store that sells only appliances and mattresses.

If you like Kenmore appliances but no longer have a Sears or Sears Outlet store nearby, you can now buy those products on Amazon.

The company’s long-term debt is down to $3.5 billion from $4.2 billion at the beginning of the year, and the company has cut down its losses due to continued aggressive cost-cutting.

That cost-cutting includes layoffs at headquarters as well as store closures, and closing stores means that there’s less money coming in.

Sears has been touting its “transformation” for years now. The company’s chairman, CEO, and major investor and lender Eddie Lampert has been using that term to describe what the company is doing since at least 2009, though that may have been referring to a different transformation eight years ago.

European Discount Carrier WOW Expanding In U.S. With More Cheap Flights

Midwesterners will soon have more options when it comes to cheap flights across the pond: Discount carrier WOW — known in Europe for its super low fares — will be expanding to four more U.S. cities, offering roundtrip fares as low as $99 for a one-way ticket.

Icelandic airline WOW Air will be adding service from four more U.S. cities this spring, expanding its current American network to 12 airports, the company announced.

Coming soon

Travelers flying out of St. Louis, Cleveland, Cincinnati, and Detroit will be able to snag flights to Iceland starting at $99.99 one way, with connecting flights to the airline’s other two dozen European destinations starting at $149.99.

Tickets are already on sale, but the flights won’t start until 2018: WOW’s Detroit service starts April 26, Cleveland on May 4, Cincinnati on May 10, and St. Louis on May 17.

Each route will have four flights per week to Keflavik airport near Reykjavik on a single-aisle Airbus A321.

As for whether folks will bite on these new fares, WOW’s founder and CEO Skúli Mogensen sees opportunity in serving the Midwest, saying it’s an underserved area. If there are cheaper flights, perhaps people who otherwise wouldn’t take a trip to Europe will do so.

“With those kind of prices, we have seen in other markets that we enter that we have stimulated the market significantly,” he told USA Today, which could spark other carriers to offer low-cost transatlantic flights.

These new Midwest additions will join WOW’s current roster of U.S. cities it serves: Baltimore, Boston, Chicago O’Hare, Los Angeles, Miami, Newark, Pittsburgh, and San Francisco.

Low-budget is big business

WOW isn’t the only budget carrier from Europe to head to our shores in search of customers, of course. Its home country rival Icelandair also announced flights from Cleveland to Reyjavik this week.

Air France — which already has low-cost carriers Hop and Transavia in Europe — has plans for a new no-frills airline serving U.S. cities this year.

Norwegian Air also recently started offering $65 one-way tickets to Europe out of smaller, regional airports in the U.S., while Lufthansa and British Airways both operate discount airlines in Asia and North America.

Whether it’s a foreign airline or a domestic name like Southwest and Spirit, low-cost carriers are driving down prices across the industry, reports The Wall Street Journal, and in turn, inspiring more people to travel who may not have otherwise.

In 2016, budget airlines carried more than one billion flyers for the first time ever, nabbing about 30% of total air travelers, notes the WSJ. We’re still a bit behind here in the U.S., where about one in three passengers flies on a discount airline. In Indian and Southeast Asian markets, 53% of seats are controlled by cheaper brands.

Chicken Skewers Sold At Costco Recalled Over Listeria Concerns

If your dinner plans include enjoying those chicken skewers you grabbed at Costco, you might want to go with plan B: More than 20,000 pounds of chicken skewers have been recalled over listeria contamination concerns.

The U.S. Department of Agriculture announced Wednesday the recall of 20,446 pounds of fully-cooked skewer products that were imported from Montreal-based Expresco Foods after the products tested positive for listeria contamination.

The recall covers West End Cuisine Grilled Mediterranean style skewers and Expresco Grilled Garlic and Herb skewers packaged on Aug. 9 and Aug. 15.

According to the USDA Food Safety and Inspection Service, import inspectors with the agency recently discovered the possible listeria contamination during routine inspection of foreign shipments.

So far, no illnesses or reports of adverse reactions to eating the products have been reported.

The chicken was sold at retailers, including Costco, in Arizona, Connecticut, Florida, Illinois, Maryland, Michigan, and Texas.

Affected products can be identified by the establishment number “36” inside the Canadian Food Inspection Agency mark and the following UPC and lot codes:

• 1.3-pound packages of West End Cuisine Grilled Mediterranean Style Chicken Skewers containing the UPC code 621588314947 and lot codes: 172562, 172640, 172571 and 172704.

• 1.09-pound packages of Expresso Grilled Garlic & Herb Chicken Skewers containing the UPC code 621588315555 and lot codes: 172563, 172668, 172669 and 172670.

Consumers who have purchased these products are urged not to consume them. These products should be thrown away or returned to the place of purchase. Customers with questions regarding the recall can contact Expresco Foods at (514) 843-2353.
