Two Police Officers Deliver Babies At Same Burger King One Day Apart

When a baby is ready to grace this world with its presence, it’s ready — even at a Burger King. At least that was the case last week for not one, but two babies born two days in a row in the parking lot of a New Jersey restaurant.

NJ.com reports that the in just over 24 hours time, the same two Denville Township police officers delivered two babies in a Burger King parking lot.

The First Delivery

The first bundle of joy entered the world around 7:24 p.m. Friday. According to a police spokesperson, the child’s parents were on their way to the hospital when they ran into heavy traffic and the mother began to experience contractions.

After pulling into the Burger King parking lot, the couple called 9-1-1.

A short time later, and with the help of the two Denville police officers and local firefighters, the woman gave birth to a baby boy.

The Second Delivery

Almost exactly 25 hours later, at around 8:30 p.m Saturday, police received an eerily similar call: A woman was in labor in the Burger King parking lot.

NJ.com reports that this couple was also on the way to a local hospital when the mother-to-be began to experience severe contractions.

Again, the same two police officers responded to the call and assisted in the birth of a second baby boy.

Costco Creates A Nightmare Before Christmas In This Seasonal Display

It’s the first half of September, which means that it’s time to celebrate our favorite holiday. No, not Halloween or Thanksgiving: The best holiday of all is Christmas/Halloween Mashup, as the classic animated film The Nightmare Before Christmas taught us all. The demands of seasonal displays mean that Nightmares Before Christmas also appear in the real world. Sometimes it’s even done well.

Reader Tim spotted this display at Costco last week, showing the inevitable life cycle of fall retail.

Keep an eye out for Christmas Creep during your own shopping trips. We’re also trying to find the first sightings of Easter candy, which usually happen sometime in early December. Our mailbox is open.

The following are not considered Christmas Creep:

• Craft stores putting out supplies for holiday-themed crafts months in advance: This is because craft projects take a long time.

• Hallmark’s ornament collection, which always comes out in July for some reason.

• Hobby Lobby, which puts its Christmas items out in late spring, doesn’t count because it may as well never take them down.

• Holiday supplies at warehouse clubs are really meant for businesses, which might buy gift wrapping supplies and decorations a few months in advance. It’s just that — as in the Costco example above — it looks really weird when multiple holidays are promoted at once, and in the same display.

Hotel, Gas Stations Accused Of Price-Gouging Hurricane Harvey Victims

By definition, price gouging is the act of increasing the prices of goods, services, or commodities to a level much higher than is considered reasonable or fair. It’s also just a shady thing to do, especially when it involves people already reeling from a natural disaster. To that end, Texas is suing three businesses for allegedly price gouging consumers before and after Hurricane Harvey.

Texas Attorney General Ken Paxton today filed lawsuits against three companies, accusing them of unfairly rising the price of fuel, shelter, and other essentials as a result of the recent hurricane.

Under Texas law, businesses are prohibited from charging exorbitant prices for necessities such as drinking water, food, clothing, and fuel during a declared disaster.

“It’s unconscionable that any business would take advantage of Texans at their most vulnerable – those who are displaced from their homes, have limited resources, and are in desperate need of fuel, shelter and the basic necessities of life,” AG Paxton said.

Yet, according to his office, these such businesses exist, and three were allegedly hard at work re-victimizing Harvey’s victims.

Paxton’s office filed separate lawsuits today against Robstown Enterprises, Bains Brothers, and Encinal Fuel Stop for allegedly price gouging consumers during or after Harvey.

Costly Lodging

Best Western-franchisee Robstown Enterprises — doing business as Best Western Plus Tropic — allegedly charged three times the normal room rate the weekend Harvey hit the area.

KXAN reports that a crew from the station stayed at the hotel chain prior to the storm, finding that their quoted price was significantly lower than what they were charged when they checked out.

The station shared a copy of the invoice with the AG’s office and the hotel later refunded 40 customers. However, the AG’s office notes that Best Western severed ties with the franchise.

Expensive Fuel

In the case of Bains Brothers, the owner of two Texaco gas stations in the Dallas-Fort Worth area, the AG claims the companies increased the price of regular unleaded fuel to $6.99 per gallon after the hurricane hit.

This price was charged on Aug. 31 despite the fact that the gas stations actually advertised the cost of fuel ranging between $3 and $4 per gallon, according to the AG’s office.

The AG’s office became aware of the issue when a customer complained that he had begun filling his tank only to discover that 12 gallons of fuel cost $85. At the time, the customer claims, the gas station advertised the fuel as costing $4.29/gallon.

Fuel prices at the Chevron-branded Encinal Fuel Stop were even more expensive, the AG’s office claims.

On Aug. 31, the company allegedly charged $8.99 and $9.99 per gallon for regular unleaded fuel.

According to the AG’s office, if found guilty of price gouging, businesses can receive a civil penalty of up to $20,000 for each violation. Businesses also face an additional fine of up to $250,000 for incidents that involved citizens over the age of 65.

More To Come

While today’s lawsuits mark the AG’s first since Harvey, the agency says it has received 3,321 complaints of price gouging following the storm.

Individuals who believe they have been scammed or the victim of price gouging are urged to report the incidents to the AG’s consumer protection hotline at (800)621-0508, via email at consumeremergency@oag.texas.gov, or online.

AT&T Expands Free HBO Offer To Include All Unlimited Wireless Plans

Five months after announcing that customers on its Unlimited Plus plan would get complimentary HBO access, AT&T says members of its cheaper Unlimited Choice wireless option will also be able to stream as much Game of Thrones as they want for free.

All current and new AT&T Unlimited Choice customers will have free HBO starting Sept. 15, AT&T announced today.

While Unlimited Choice is $30/month less than Plus, data speeds and video quality are restricted: There’s a max speed of 3Mbps and video can only be streamed in standard definition (about 480p) on AT&T’s LTE network.

For all Unlimited customers, AT&T will provide free access to HBO in a few ways:

• If you have HBO through DirecTV, DirecTV Now, or AT&T U-Verse, you’ll no longer be billed for the channel.

• If you have DirecTV, DirecTV Now, or U-Verse but don’t currently subscribe to HBO, it will soon be added to your package free of charge.

• If you don’t have DirecTV, DirecTV Now, or U-Verse, you can access HBO through the DIRECTV NOW and HBO GO apps.

AT&T and Time Warner have not, in fact, technically merged yet, but they sure do seem to be ready for the day. This appears to be yet another indication that AT&T is confident that their merger will be approved, as it’s unlikely that it would be so willing to give away premium video content if it didn’t expect HBO to become part of the family soon.

Here’s The Stuff You Really Want To Know About Apple’s New iPhones

It’s been rumored for months, and recently leaked in detail but finally, confirmation day has come: Apple announced new iPhones and a slew of other stuff today at an event in Cupertino.

[We will be updating this post throughout and after the Apple event.]

CEO Tim Cook began by honoring late apple CEO Steve Jobs, for whom the company’s new theater on Apple’s new campus (the praises of which Cook sang at length) was named, and asking everyone to consider donating to relief efforts for those affected by Hurricanes Harvey and Irma before getting into the meat of his presentation.

Yes, there are new phones

After a decade, it’s definitely no secret: New year, new iPhone.

Apple’s shaking things up a little bit this year, though. They’re skipping the 7S generation that we might ordinarily expect a year after the 7, and going straight to the iPhone 8 and 8 Plus.

The iPhone 8 and 8 Plus promise to use fancy new high-speed chips and provide spectacular color displays, as usual, and alas, the headphone jack does not come back. This time, however, the aluminum in the phone is covered in glass both on the front and back for extra breakability, although Apple claims it is the “most durable ever in a smartphone.”

The phone comes in three colors: Silver, “space grey,” and gold, and Apple touts increased “splash” resistance. So maybe don’t jump into the pool with your iPhone in your pocket, but it might survive if it’s on the table when your beverage of choice takes a tumble.

Apple also praised the updated cameras in the iPhone 8, displaying a wide array of images taken to highlight the camera’s perception of color and texture.

London Sewer Officials Fighting Intense “Sewer War” Against 820-Foot ‘Fatberg’

Every time you flush a disposable wet wipe down the toilet, just imagine sewer workers screaming, “Nooooo!” That’s because no one wants to battle a monster “fatberg” of the sort currently blocking London’s sewers.

If you thought a fatberg the size of a 747 was impressive, you ain’t seen nothing yet: Thames Water workers have embarked on a three-week “sewer war” against a massive, hardened chunk — made of wet wipes, fat, condoms, diapers, and sanitary products — that’s currently blocking a section of sewer the length of almost three (American) football fields.

The Whitechapel fatberg is one of the largest ever found, the agency says, with the extreme rock-solid mass weighing in at 130 metric tons, or the same as 11 double decker buses.

“This fatberg is up there with the biggest we’ve ever seen. It’s a total monster and taking a lot of manpower and machinery to remove as it’s set hard,” said Matt Rimmer, Thames Water’s head of waste networks, who adds that it’s “like trying to break up concrete.”

An eight-person crew is using high-powered jet hoses to break up the mass before sucking it out with tankers. That material will then be hauled to a recycling site.

During an eight-to-five workday, workers will remove an average of 20 to 30 metric tons per shift.

Fatbergs can wreak havoc aboveground, too, Rimmer notes.

“It’s fortunate in this case that we’ve only had to close off a few parking bays to get to the sewer,” he notes. “Often we have to shut roads entirely, which can cause widespread disruption – especially in London.”

Just like his American counterparts, who have begged citizens not to flush disposable wipes, Rimmer says it’s frustrating as these situations are “totally avoidable and caused by fat, oil, and grease being washed down sinks and wipes flushed down the loo.”

Instead of sending this stuff into the city’s sewers, folks should dispose of them in the garbage.

“When it comes to preventing fatbergs, everyone has a role to play,” Rimmer says. “Yes, a lot of the fat comes from food outlets, but the wipes and sanitary items are far more likely to be from domestic properties. The sewers are not an abyss for household rubbish and our message to everyone is clear – please ‘Bin it – don’t block it’.”

Kroger Drops Lawsuit Against Lidl Over Similar Store Brand Names

Are consumers likely to confuse one of Kroger’s store brands, Private Selection, with one of Lidl’s store brands, Preferred Selection? Kroger filed a lawsuit a few months ago against Lidl, a German chain opening its first stores on this side of the Atlantic, claiming that the store brand names were too similar. Now Kroger has dropped the suit.

Lidl (it rhymes with “needle”) is a popular discount grocery chain in Europe, and is slowly opening stores in the United States. As of this writing, it has locations in North Carolina, South Carolina, and Virginia.

In its United States expansion, the chain is aiming for a little more of an upscale market than Aldi, the German discount supermarket that Americans already love. The stores carry some brand name products, but focus on private-label merchandise.

This week, Kroger and Lidl agreed to dismiss the case [PDF], with each side covering its own legal expenses for litigation over the Private Selection/Preferred Selection trademark.

In its answer to Kroger’s initial complaint [PDF], the parent company of Lidl USA argued that the retailer chose and applied for a trademark for its Preferred Selection products in good faith, without intending for anyone to mistake them for products from Kroger.

The Kroger products sold under the Private Selection brand are high-end items, and Lidl argued that its Preferred Selection products are imports, but not marketed as high-end or competing with the brands sold at Kroger stores. A judge declined to issue an injunction against Lidl that would have prevented the retailer from selling Preferred Selection products in stores, and the case was headed for trial.

When we put the question to Consumerist readers in a poll, 59% of you said that you didn’t really see how customers would confuse the store brands.

4 Things To Remember To Not Get Scammed In Wake of Equifax Breach

As everyone now knows, 143 million Americans had their personal data compromised during a two-month-long data breach at credit reporting agency Equifax earlier this year. Authorities are now reminding consumers to watch out for bad actors looking to profit from everyone’s worries about their newfound vulnerability.

New York Attorney General Eric Schneiderman on Monday warned consumers to be vigilant against possible hacking and phishing attempts following the massive Equifax data breach.

Phishing is a type of online scam that targets consumers by sending them an email or placing a phone call that appears to be from a well-known source – in this case, Equifax or your bank. The scammers ask for personal identifying information and then use the information to open new accounts, or invade the your existing accounts.

The Breach

Equifax announced last week that hackers had gained “unauthorized access” to their systems — i.e. a data breach — for nearly two-and a half months. The attack, which was discovered July 29, involved the following personal information: names, dates of birth, addresses, Social Security numbers, and driver’s license numbers.

That is bad, very bad; it’s basically the identity theft jackpot. Every account that needs verification that you’re you asks for that exact set of data, so now anyone can be you.

Additionally, Equifax adds, another 209,000 customers had their credit card numbers stolen, and another 182,000 customers had “personal identifying information” listed from dispute documents.

Bad Actors

Schneiderman points out that ne’er-do-wells may take this unfortunate incident and turn it into an opportunity to further victimize those affected by the breach, as well as those whose information wasn’t hacked.

“In addition to taking measures to protect their credit cards and bank accounts, New Yorkers should also think twice before clicking on any suspicious links claiming to be from Equifax or financial institutions,” AG Schneiderman said in a statement that applies not only to New Yorkers, but all consumers.

To that end, consumers should be on the lookout for these common phishing attacks:

• Emails that claim to be from Equifax that claim you can check to see if your data is compromised.

• Emails that claim a problem with your credit card, your credit record, or other personal information.

• Calls from scammers who claim they are from your bank or credit union.

• Fraudulent charges on any credit card because your identity was stolen.

How To Spot A Scam

The Federal Trade Commission offers consumers a wealth of information related to protecting themselves from and spotting these types of phishing scams.

“Phishing scammers make it seem like they need your information or someone else’s, quickly – or something bad will happen,” the FTC notes.

For instance, a scammer might say your account will be frozen, you’ll fail to get a tax refund, your boss will get mad, even that a family member will be hurt or you could be arrested.

“They tell lies to get to you to give them information,” the agency adds.

Be Cautious & Report

The FTC notes that individuals should be cautious about opening any attachments or clicking on links in such emails. Even if the email appears to be from a legit source, those addresses could be spoofed or those accounts could themselves have been hacked.

When you receive such an email, the FTC suggests consumers do their own typing. Use your search engine to look up the website or phone number provided in the email. Even though a link or phone number in an email may look like the real deal, scammers can hide the true destination.

If you’re not sure of the legitimacy of an email, just call the company yourself.

“If you think a company, friend or family member really does need personal information from you, pick up the phone and call them yourself using the number on their website or in your address book, not the one in the email,” the FTC notes.

The same can be advised when receiving a suspicious phone call; ask for a number to call back and check the authenticity by searching online. You can also call the company to ensure they are actually contacting you.

Consumers who believe they have been targeted by a phishing scam are urged to report the incident to the FTC at FTC.gov/complaint. Individuals should also forward the phishing email to spam@uce.gov.

Puppies Sold At Pet Stores Linked To Multistate Bacterial Outbreak

What’s the first thing you want to do when you see an adorable puppy? Probably snuggle and cuddle the heck out of it. But federal officials say there’s a multistate outbreak of a nasty bacteria going around, and it’s being spread by puppies sold at a national pet store chain.

The Centers for Disease Control and Prevention, along with the Ohio Department of Health and several other states, are investigating a recent spate of Campylobacter infections that appear to be connected to puppies sold through Petland.

Not feeling too hot

So far, 39 people living in seven states — Florida, Kansas, Missouri, Ohio, Pennsylvania, Tennessee, and Wisconsin — have laboratory-confirmed infections or symptoms.

Of those cases, 12 are Petland employees who had contact with puppies sold in stores. The other 27 either recently purchased a puppy at Petland, visited a Petland, live in a home with a puppy sold through Petland — or visited someone who does — before they got sick.

The most recent illness was reported on Sept. 1 this year, but reports started as far back as Sept. 15, 2016.

The CDC says that Petland is cooperating with public health and animal health officials to address the outbreak.

Bad bacteria

Although most cases are associated with eating raw or undercooked meat or poultry, Campylobacter can spread through contact with dog poop (feces). It usually doesn’t hop from one person to another, however.

Symptoms of infections in both people and animals include vomiting, bloody diarrhea, and fever. Humans usually recover within a week without treatment. People more likely to get a severe infection include:

• People with weakened immune systems (such as people with the genetic blood disorder thalassemia or HIV or people receiving chemotherapy)
• Children younger than 5 years
• Adults 65 years and older
• Pregnant women

The CDC has some handy advice to pet owners to avoid getting sick, as well as guidance for pet store workers who may come into contact with infected puppies.

More controversy?

Petland — the only major national chain that sells dogs from commercial breeders — was hit with a class-action lawsuit in July, notes The Washington Post, accusing it of defrauding customers by “guaranteeing” puppies it allegedly knew were prone to illnesses and other defects.

The Animal Legal Defense Fund claims that Petland only performs cursory inspections before providing a “Health Warranty” to purchasers of puppies. Campylobacter isn’t one of the conditions customers have reported to ALDF, but the group’s director of litigation says the outbreak news is hardly surprising.

“It’s not hard to see how animals raised in these cramped and unsanitary conditions, trucked hundreds of miles from puppy mills to the pet stores, intermingled with other fragile young animals and handled by numerous employees and customers could become disease vectors,” Matthew Liebman told WaPo.

Petland’s CEO Joe Watson called the lawsuit’s allegations “baseless and tired.”

“Regardless of where you obtain your family dog, all dogs are carbon-based life-forms, and just like our own kids, they are subject to a wide variety [of] illness,” he said in an email to WaPo. “We take every precaution possible to ensure the health of our pets.”
