GOP Moving Forward With Plan To Block New Legal Protections For Bank, Credit Card Customers

The Consumer Financial Protection Bureau recently finalized new rules that prevent banks and other financial institutions from stripping customers of their constitutional right to a day in court. As expected, bank-backed lawmakers in both the House and Senate are now planning to pass fast-track legislation that would undo these protections and make sure banks retain their “get out of jail free” card.

The new CFPB rule applies to the use of “forced arbitration” clauses in consumer contracts. These little bits of legalese, often buried very deep in fine-print agreements that the customer has no authority to change, generally do two things: First, they prevent the customer from filing a lawsuit against the company. Instead, all disputes must be settled through a private — frequently confidential — arbitration process outside of the legal system.

Second, many arbitration clauses include a ban on class action claims, even through arbitration. So even if there are thousands — or in cases like the Wells Fargo’s fake account fiasco, potentially millions — of customers who have all been wronged in a similar way, they are barred from joining their complaint into one case. Instead, each of those customers must go through arbitration on his or her own, and since arbitration results set no legal precedent (and the decisions may be confidential), it’s possible that some customers could have different arbitration outcomes despite having the exact same claim.

The CFPB rule does not outlaw the use of arbitration clauses. Rather, it prevents affected financial operations from using these clauses to prevent class actions. Thus, individual cases could still be resolved through arbitration, but banks under CFPB’s oversight would not be able to block multiple wronged customers from combining their cases.

Now, two heavily bank-backed lawmakers are expected to introduce legislation to roll back the CFPB rule. Rep. Jeb Hensarling (TX) and Sen. Mike Crapo (ID) will attempt to use the Congressional Review Act (CRA) — a law that allows lawmakers to voice their disapproval of new federal regulations — to stop the arbitration rule.

Under the CRA, lawmakers in each chamber of Congress vote on resolutions of disapproval. If a simple majority in each chamber approves the resolution, it goes to the White House. Given President Trump’s zeal for deregulation, and his ongoing opposition to CFPB Director Richard Cordray, we don’t see a world in which this CRA resolution would not be signed.

Rep. Hensarling, Chair of the House Financial Services Committee, has received millions of dollars from banks and other businesses with a direct interest in shutting down the CFPB rule. According to the Center for Responsive Politics, the Texas Republican’s campaign took in $1.9 million from the financial services industry in 2016 alone, more than 10 times the amount received from any other industry:

Similarly, Crapo’s campaign took in more than $4 million from the financial sector last year, nearly four times the total from any other industry:

Until the Trump administration, the CRA had been used successfully only once in its two decades of existence. Since February, it’s been used around a dozen times to overturn regulations put in place during the final months of the Obama White House, most notably the FCC’s new rules regulating online privacy.

Most CRA votes have thus far been along strict party lines, though 15 Republicans did vote against their party’s effort to overturn the privacy rule.

Supporters of the CFPB rule will likely be putting significant pressure on moderate GOP senators. As was demonstrated earlier this week, only three “no” votes are needed in that chamber to stop fast-tracked legislation.

Samsung Apologizes For Descriptions Of Male, Female Bixby Voice Assistants

Samsung has officially launched its very own voice-controlled artificially intelligent assistant Bixby, the long-awaited answer to Siri and Alexa, and the service is already making a splash… just not one Samsung probably imagined. 

Gizmodo reports Samsung is apologizing and working on changes to the way it describes the voice-assistant after users found the characterizations sexist.

Users of Bixby, which began rolling out today, noticed something a bit different about Samsung’s voice-assistant: It could be configured to be male or female.

While this might be a welcome change for some users, the way Samsung describes the two versions of the assistant decidedly wasn’t.

Under the Bixby “language and speaking style” menu, Samsung notes in hashtags that the female version of Bixby is “chipper” and “cheerful” while the male version is “assertive” and “confident.” Both versions are described as “clear.”

Samsung tells Gizmodo that it is working to remove the hashtag descriptions, noting that it is “constantly learning from customer feedback.”

There Are Only 32 Retail Gas Stations Left In Manhattan

Every day, new people arrive in New York City, and those people need housing. In response to that demand, developers in Manhattan have been busy knocking down old buildings and putting up new ones. One casualty of that real estate boom? Gas stations, which have become increasingly rare in recent years.

An Endangered Species

The New York Times noted in 2016 that the pace of development had accelerated, wiping 30 gas stations off the map since 2008. At that time, only 50 were open to the public on the island of Manhattan.

Their numbers continue to dwindle: According to data from the city’s Department of Consumer Affairs, there are now only 32 retail gas stations open as of last year.

What’s There Instead?

So where have all the gas stations gone? Curbed has a great interactive map showing what each former fuel location has been turned into, from developments that mostly include apartment complexes, condominiums, shopping centers, and office buildings.

To that end, if you need a place to live, this map might be helpful in finding an apartment.

Some simply sit empty and unused, waiting to be turned into a tall glass building filled with people who probably don’t have cars. And if they do, they may have a tough time finding a gas station to fuel it up.

Lawmakers Call For Removal Of Education Dept. Civil Rights Chief After College Rape Claims

A week after the head of the Department of Education’s Civil Rights division publicly apologized for making an unsubstantiated and unsourced claim that nine in 10 sexual assault and harassment allegations are baseless and can be tied back to nothing more than too much drinking and bad breakups, lawmakers are calling for the her removal.

Senators Richard Blumenthal (CT), Clair McCaskill (MO), and Kirsten Gillibrand (NY) called on Education Secretary Betsy DeVos to remove Acting Assistant Secretary for Civil Rights Candice Jackson from her position as the top official in charge of enforcing rights protections at institutions of higher education.

In a letter [PDF] to DeVos, the senators raise concerns regarding both Jackson’s comments and actions taken by the Department, that they believe “have the potential to systemically undermine critical protections for students under Title IX specific to the safeguards for victims of campus sexual assault.”

The Claim & Apology

Jackson addressed campus sexual assault last week in an interview about the Trump administration’s plan to review so-called Title IX civil rights disputes, involving sexual discrimination.

During the New York Times interview, Jackson noted that, in her opinion, “the accusations — 90 percent of them — fall into the category of ‘we were both drunk,’ ‘we broke up, and six months later I found myself under a Title IX investigation because she just decided that our last sleeping together was not quite right.’”

When Consumerist inquired about Jackson’s 90% claims and her sourcing, the Department of Education issued an apology on her behalf. However, this isn’t enough, the lawmakers told DeVos.

Call For Dismissal

“The remarks were not just ‘flippant;’ they were ignorant and dangerous,” the lawmakers wrote. “These comments, along with a series of other actions taken by Jackson to weaken OCR protections for students show that she is unqualified for the position and should be removed as Acting Assistant Secretary for Civil Rights.”

The lawmakers point to an internal staff memo from Jackson to OCR’s regional directors instructing them to narrow the scope of investigations related to Title IX postsecondary education sexual violence complaints.

They also cite several Department actions that suggest it will step back from its commitment to enforce Title IX.

For instance, during DeVos’ Jan. 17 confirmation hearing she refused to commit to upholding the guidance set forth in a 2011 letter by OCR.

Then in May, the fiscal year 2018 budget request submitted by the Department of Education decreased funding for OCR, which would resume in 46 fewer full-time staff members. This, despite the fact that the Department acknowledged that OCR had seen a significant uptick in the number of complaints it receives each year.

Additionally, the senators note that just last week the Department suggested that it would be changing the way it handles complaints of sexual violence during a series of Title IX listening sessions.

During these sessions, DeVos stated that, “there was a time when women were essentially dismissed.” To this, the lawmakers contend that many survivors of campus sexual violence continue to be dismissed.

“We are frustrated and appalled by the fact that the Department appears to be abandoning its long-standing commitment to holding educational institutions accountable for protecting students from sexual harassment, including sexual violence,” the senators write.

The lawmakers ask DeVos to provide written response to the letter by Aug. 15 and request a personal meeting with the Secretary to discuss the importance of sexual assault protection for all students.

Former Alfred Angelo Employees Perform Potentially Illegal Wedding Gown Rescue Mission

Last week, the bridal and special-occasion gown brand Alfred Angelo abruptly closed both its retail boutiques and its wholesale business. Other bridal stores are taking advantage or helping out (depending on your point of view) with sales and offers of help, and the former employees of at least one store went back in against the bankruptcy court’s rules to fetch paid-for gowns and distribute them to customers.

The Rescue Operation

Three former Alfred Angelo store employees in California teamed up to make sure that customers didn’t have to worry about the whereabouts of their gowns. There’s a tiny problem with this, though, since the company’s bankruptcy estate owns those gowns and the stores now.

An attorney explained to Scripps Media that the former employees should not have entered the stores and grabbed dresses and paperwork, since a temporary restraining order now governs the stores and their property.

As far as the bankruptcy court is concerned, women who hadn’t yet picked up their gowns are “third parties,” not people who paid for merchandise and should have the right to pick it up.

“The actions of the employees may constitute theft or grand larceny under state law and could subject them to state criminal prosecution,” the bankruptcy attorney explained. “Third parties receiving stolen items could also face state criminal charges and prosecution.”

The ex-employees who organized the wedding gown raid don’t especially care.

“Like, are you really going to come after a bride?” the group’s ringleader asked, referring to herself as the “Robin Hood of bridal.” She said that other stores’ former employees were performing similar missions to unite dresses and brides, but didn’t specify which ones.

At least there are sample sales

For brides whose dresses are still on order, things are murkier. Stores ranging from giant big-box chain David’s Bridal to tiny boutiques have special deals for affected customers, and women across the country are offering their own gowns to brides in need.

“It was a great company. They gave you excellent service but what dirty pool to leave us hanging there,” the owner of an independent bridal boutique in Traverse City, MI told the Detroit Free Press.

Another store owner told the Free Press that she would be offering huge discounts on Alfred Angelo sample gowns in stock, since she wouldn’t be taking any more orders based on those samples.

David’s Bridal is offering discounts on its own products and, perhaps most helpfully, waiving rush fees for alterations on gowns purchased from Alfred Angelo for events coming up this summer.

The company speaks

Alfred Angelo finally posted a notice on its website, admitting that it filed for bankruptcy on July 14, and directing customers with questions about their orders to the bankruptcy trustee.

Her address is alfredangelo@mjstrustee.com. In the message, include your order number, your name as it appears on the order, and the location of your purchase.

“We apologize for the inconvenience and hardship resulting from this event,” the company said in its statement. “We appreciate your patience. Thank you.”

Amazon Spark: Like Instagram, But Dedicated To Convincing You To Buy Stuff

Amazon’s new Spark feature is a photo feed that’s basically dedicated to getting Prime members to buy more stuff.

How It Works

The new feature is available through the “Programs & Features” menu option in main Amazon ap. Like Instagram, users are supposed to post stories, thoughts, and images of products they like. Others can react to them in comments or with “smiles.”

It’s also a bit like Pinterest, in that users can discover new things by following interests and people: Once you’ve selects topics you’re interested in — like Home Decor or Do It Yourself — Amazon will create a feed of “personalized content from other Amazon customers with similar interests as you.”

That’s not all, of course — there’s money to be made!

Shop It To Me

The whole idea here is to get you to see stuff you like, and then get you to buy it without ever leaving the Amazon world.

All you have to do is tap on a product link or photos with the shopping bag icon:

You can buy whatever it is you’ve just seen through the Amazon app.

Unfortunately, there doesn’t appear to be any way to purchase someone’s entire life.

Frontier Airlines Adding Flights To These 21 New Cities, Will Double Its Routes

When we hear complaints about their flights on Frontier Airlines, what we don’t hear is that customers want more of them. Yet the discount airline plans to expand its routes, running twice as many flights by this time next year.

CNN reports (warning: auto-play video at that link) that those new routes have been chosen to overlap territory where large traditional airlines dominate, and give the airline more flights to popular tourist spots in Florida like Fort Myers, Tampa, Miami, and Orlando.

Once all of the planned expansion routes are up and running, only Southwest will have more routes to Florida than Frontier.

More flights, not better service

Low-cost carriers like Frontier are focused on expansion and on flying more people rather than squeezing more revenue out of each one, and the airline does fly planes that are more full on average than other airlines. Only fellow discount carrier Spirit had lower customer satisfaction scores in the last American Customer Satisfaction Index report.

A focus on cost-cutting and high volume can lead to cascading problems, though. The airline failed to cancel flights during a massive snowstorm late last year, stranding passengers at its hub in Denver. Frontier’s pilots released a statement blaming the mess on bad management, specifically, the company’s “misplaced focus on cost-cutting that has placed Frontier near the very bottom of the industry In operational performance and customer satisfaction.”

That quality travel will be available to 90% of air travelers in the continental United States once the airline completes its expansion.

Frontier made a chart of which new cities and routes became available for purchase this week.

Chipotle Reopening Virginia Store Closed Over Possible Norovirus

A Virginia Chipotle restaurant will reopen today after it was temporarily closed following reports that some customers became violently ill after eating there. 

The Sterling, VA, location was slated to reopen Tuesday, but local health officials recommended the chain keep the restaurant closed another day as a precaution, the Associated Press reports.

Chipotle says that the additional closure time allowed multiple teams to thoroughly sanitize all surfaces in the restaurant.

“The safety and well-being of our customers is always our top priority,” Steve Ells, Chipotle CEO, said in a statement. “It is unfortunate that anyone became ill after visiting our restaurant, and when we learned of this issue, we took aggressive action to correct the problem and protect our customers.”

The restaurant closed Monday for sanitization following reports that customers became ill after eating there. The fast casual chain attributed the illnesses to norovirus, which can spread when a contaminated person handles food.

Eight reports on the site iwaspoisoned.com indicated 13 customers fell sick after eating at the restaurant between July 14 and July 15.

In all, customers reported “vomiting violently” and “violent stomach cramps” for several days after eating at the restaurant. At least one person made two trips to the hospital.

Stock Hit

Chipotle, which has been trying to bring back customers after a spate of food-borne illness issues, took at hit on Wall Street after reports of the possible norovirus issues came to light.

The chain’s shares dropped more than 4% Tuesday. It remained down 1.4% Wednesday, at a valuation of $369.56.

Mad Cow Disease Discovered In Single Alabama Cow: What Now?

Although the words “mad cow” may strike fear deep into the center of your beef-loving stomach, there’s no need to freak out over a recent report of a single cow in Alabama that has come down with the disease.

According to the U.S. Department of Agriculture, inspectors detected an atypical case — meaning it was spontaneous and rare incident — of Bovine Spongiform Encephalopathy (BSE), a neurologic disease of cattle, in an 11-year old cow in Alabama.

The animal was discovered during routine surveillance at an Alabama livestock market, the state’s agriculture department said.

Following delivery to the livestock market the cow later died at that location, officials said. Routine tissue samples were taken and sent off for testing and confirmation.

Your Burger Is Safe

First of all, don’t panic: Even though BSE can be fatal to humans that eat tainted meat, this animal never entered slaughter channels and at no time presented a risk to the food supply, or to human health in the U.S., the USDA says.

Mad cow isn’t contagious, so there is no fear it will spread to other animals that were nearby.

Atypical vs. Classical Mad Cow

There are two kinds of mad cow:

Classic BSE: This is the kind of mad cow disease that occurred primarily in the United Kingdom, and has been linked to variant Creutzfeldt-Jakob disease in people. The primary source of infection for classical BSE is feed contaminated with the infectious prion agent, such as meat-and-bone meal containing protein derived from rendered infected cattle.

However, Food and Drug Administration regulations have prohibited the inclusion of any kind of mammalian protein in feed for cattle other ruminants since 1997 and have also prohibited high risk tissue materials in all animal feed since 2009.

Atypical: This form arises rarely and spontaneously in all cattle populations, generally occurring in cattle eight years or older. It is not usually associated with ruminant by-products being fed to ruminants.

Mad Cow In The U.S.

This is only the country’s fifth detection of mad cow, the USDA says: In the four previous cases, the first was a case of classical BSE imported from Canada; the rest have been atypical. Again, this is likely due to the fact that it’s illegal to feed cattle anything containing ruminant byproducts.

FBI To Parents: Watch Out For Kids’ Privacy With Internet-Connected Toys

A basketball, a Lego set, or a box of crayons is largely what it seems, but modern “smart toys and entertainment devices” for kids have a lot of things in them that can collect sensitive data. And as more and more of a kid’s nursery fills up with gadgets that connnect to Bluetooth, the web, or parent apps, the feds are advising parents to be wary.

The FBI’s public service announcement doesn’t outright say not to buy connected toys, but it does say that parents and caretakers need to be aware of the vulnerabilities “smart” toys present.

What’s the issue?

The moving parts that you don’t see, in your kids’ toys, include “sensors, microphones, cameras, data storage components, and other multimedia capabilities,” the FBI notes. All of those collect data in ways you may or may not be aware of.

That’s on top of any data a toy or its associated app may have asked you for right when it was first set up: parents’ and childrens’ names, addresses, email addresses, phone numbers, photos, and other identifying information.

Once that data is collected, you probably have very little idea how a company is transmitting, using, and storing it. And that’s aside from the issue that any sensor and database is hackable, and there are good odds that whatever company is transmitting and storing your kid’s personal data is not applying great data security practices to it.

What can I do about it?

Well, that’s a little trickier.

The FBI advises that, basically, you should read the manual. Look for, and carefully read, a company’s privacy policy and user agreement to see if the company does something you don’t want with the data it collects from your kids.

Also scour those policies for references to third parties that a company may disclose to — a toy’s data may go farther than you think.

Try to do some other research too, the FBI advises, to find out if the company that makes a certain toy has a history of data breaches, and what its policy with regard to data loss notification actually is.

But that’s not much.

A key problem with putting all of this information into a privacy policy is that most consumers won’t see it until after a product has been opened and activated and can’t be returned.

It’s not as if the product disclosure is on the box, after all; largely you have to go to a website or download a companion app to a device in order to activate a child’s toy, and the moment of activation is the first time you will be presented with the option to view and accept the toy’s terms and conditions.

It’s all well and good to say that parents should research a toy before they buy it, but that also needs to apply to basically every grandparent, aunt, uncle, cousin, or friend in a child’s life, too. And it’s not just about the toys your own children have at home; once your kids clear preschool age, they’re likely to be playing at their friends’ homes on occasion, too.

This is starting to sound kind of familiar…

The FBI’s warning is not merely hypothetical.

You may remember hearing about My Friend Cayla and the i-Que Intelligent Robot. These toys listen to kids, collect voice recordings, and then send them to a third-party processor.

In Dec. 2016, a number of consumer groups, including our colleagues at Consumers Union, filed a complaint with the Federal Trade Commission alleging that these toys were running afoul of the laws that protect childrens’ privacy, and that the makers were behaving in an unfair and deceptive way.

Researchers working around the world found that the toys were easily hacked, and that their privacy policies were all but impossible to find and could be changed and updated without notice to the consumers.

The toys have since been banned in Germany, where parents are ordered to destroy one if the have it or else face a steep fine.

Flying From Mexico To The U.S.? Here’s What You Need To Know About New Laptop Rules

Although the U.S. has lifted the laptop ban on all foreign airlines it put in place in March, travelers flying here from Mexico with such large electronic devices will get their chance to grumble over new, longer security checks.

New Procedures

Starting today, Mexico’s airlines are implementing extra security checks for anyone flying on direct flights to the states with portable electronic devices larger than a phone, the country’s civil aviation authority announced (via CNN).

“Airlines will apply extraordinary measures” beginning on Wednesday, the General Directorate of Civil Aviation of the Ministry of Communications and Transportation said in a statement.

• Passengers should show up at the airport three hours before departure so you have enough time to deal with new procedures.

• Be prepared to pull out any large electronic devices you’re carrying on while going through security — without any cover or other protection.

Ban Déjà Vu

Earlier this week, the Department of Homeland Security has lifted its ban on large electronics in airplane cabins from the few airlines that remained subject to the March policy. According to the TSA, the only airport still affected by the ban is King Khalid International Airport.

In June, DHS announced that all airlines around the world that fly to the U.S. will also have to put security upgrades in place if they want to avoid a ban. The agency said at the time that it’s raising “the global baseline of global aviation security” to accomplish its goal of reducing “insider threats and identify suspicious passengers.”
